1. INTRODUCTION

These Terms of Service ("Terms") govern your access to and use of the StartDotCom platform, websites, applications, APIs, software, tools, AI-powered services, content, products, and related services (collectively, the "Services").

By creating an account, accessing, browsing, subscribing to, or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

These Terms form a legally binding agreement between you ("User", "Customer", "you", or "your") and StartDotCom, operated by TechDotAI Ltd and its affiliates ("StartDotCom", "Company", "we", "our", or "us").

4. ACCOUNT REGISTRATION

You are responsible for:

• Maintaining account security.
• Protecting login credentials.
• Maintaining accurate information.
• Restricting unauthorized access.
• All activities performed under your account.

You must notify us immediately of any suspected unauthorized access or security breach.

StartDotCom is not responsible for losses arising from compromised credentials caused by user negligence.

5. ACCEPTABLE USE

• Engage in fraud or phishing activities.

• Resell Services without authorization.

We may investigate violations and take any action we deem appropriate.

6. USER CONTENT

You retain ownership of content you submit to StartDotCom.

By uploading, creating, submitting, storing, generating, publishing, or processing content through the Services, you grant StartDotCom a worldwide, non-exclusive, royalty-free licence to host, store, process, display, reproduce, modify, and distribute solely for the purpose of operating, improving, securing, and delivering the Services.

You represent and warrant that:

• You own or control all rights necessary to the content.
• Your content does not violate laws.
• Your content does not infringe third-party rights.

You remain solely responsible for all content you create, upload, publish, or distribute.

7. AI GENERATED CONTENT

StartDotCom uses artificial intelligence technologies to generate outputs. AI-generated outputs may include:

• Marketing copy
• Emails
• Websites
• Landing pages
• Social media content
• Product descriptions
• Branding assets
• Legal templates
• Business recommendations
• Financial projections
• Strategic suggestions

AI outputs may contain inaccuracies, omissions, outdated information, errors, or unintended results.

You acknowledge and agree that:

• AI outputs are generated automatically and may not always be accurate.
• Human review is required before reliance or publication.
• You are solely responsible for evaluating outputs.

StartDotCom makes no guarantee regarding the accuracy, completeness, legality, fitness, reliability, or suitability of AI-generated outputs.

8. NO PROFESSIONAL ADVICE

StartDotCom is a technology platform.

Nothing provided through the Services constitutes:

• Legal advice
• Tax advice
• Accounting advice
• Financial advice
• Investment advice
• Medical advice
• Regulatory advice
• Professional consulting advice

You should obtain professional advice before relying on any information generated by the platform.

9. SOCIAL MEDIA PUBLISHING

Users may connect third-party social media platforms. Users remain solely responsible for:

• Content created, scheduled, and published.
• Compliance with platform rules (including Meta, Facebook, Instagram, LinkedIn, X, TikTok, YouTube, Pinterest, and Google policies).

StartDotCom is not responsible for:

• Account suspensions or content removals.
• Reach reductions or shadow bans.
• Platform penalties or enforcement actions.

10. THIRD-PARTY SERVICES

The Services may integrate with third-party providers, such as:

• Stripe
• PayPal
• Google
• Meta
• LinkedIn
• OpenAI
• Anthropic
• AWS
• Brevo
• Twilio
• HubSpot

Third-party services operate independently. StartDotCom is not responsible for:

• Third-party failures or service interruptions.
• Security incidents.
• Policy or pricing changes.

Your use of third-party services is governed by their own terms.

11. SUBSCRIPTIONS AND BILLING

Certain Services require paid subscriptions. By subscribing:

• You authorize recurring charges and agree to applicable pricing.
• You authorize payment processing providers.

Subscription fees are generally non-refundable unless required by law. Failure to pay may result in:

• Suspension or downgrade.

You may not copy, resell, repackage, reverse engineer, reproduce, or distribute these assets without written permission.

13. SECURITY

We implement reasonable technical and organisational measures to protect data. However, no system is completely secure.

Users acknowledge that:

• Internet communications carry inherent risks.
• Security cannot be guaranteed absolutely.
• StartDotCom does not warrant uninterrupted or error-free operation.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARTDOTCOM SHALL NOT BE LIABLE FOR:

• LOST PROFITS
• LOST REVENUE
• BUSINESS INTERRUPTION
• LOSS OF DATA
• LOSS OF GOODWILL
• INDIRECT/CONSEQUENTIAL DAMAGES
• INCIDENTAL/PUNITIVE DAMAGES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO STARTDOTCOM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless StartDotCom, its directors, officers, employees, contractors, affiliates, and partners from claims arising from:

• Your content or your use of the Services.
• Violation of these Terms, laws, or third-party rights.

17. TERMINATION

We may suspend or terminate accounts at any time where:

• Terms are violated.
• Fraud is suspected.
• Security risks arise.
• Legal obligations require action.

Termination does not affect accrued rights or obligations.

18. CHANGES TO SERVICES

We may modify, suspend, discontinue, enhance, or replace any portion of the Services at any time.

We are not liable for resulting impacts.

19. GOVERNING LAW

These Terms shall be governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless otherwise required by applicable consumer protection laws.

ENTERPRISE DATA PROCESSING

Where StartDotCom processes personal data on behalf of a customer acting as a controller, StartDotCom acts as a processor and shall process personal data only in accordance with documented customer instructions, applicable law, and the StartDotCom Data Processing Policy.

Customers remain responsible for ensuring that they have appropriate legal bases, permissions, notices, and consents for all personal data submitted to the Services. Where required by law, customers shall enter into a separate Data Processing Agreement ("DPA") with StartDotCom.

GDPR ARTICLE 28 COMPLIANCE

Where UK GDPR, EU GDPR, or equivalent regulations apply, StartDotCom shall:

• Process personal data only on documented instructions.
• Ensure confidentiality obligations apply to personnel.
• Implement appropriate technical and organisational security measures.
• Assist with data subject rights requests and security incident obligations.
• Delete or return customer data upon termination, subject to legal retention obligations.
• Maintain records required by applicable law.

Customers acknowledge that StartDotCom may use approved subprocessors necessary to operate the Services.

AI MODEL TRAINING RESTRICTIONS

StartDotCom does not use customer business data, customer confidential information, customer uploaded files, customer CRM records, customer emails, customer ecommerce data, customer financial data, customer social media content, or customer proprietary information to train publicly available artificial intelligence models without explicit permission.

Customer content may be processed by artificial intelligence systems solely for the purpose of providing requested Services.

Enterprise customers may request additional contractual restrictions through separate agreements.

MARKETPLACE AND THIRD-PARTY PROVIDER DISCLAIMER

StartDotCom may provide access to third-party service providers, consultants, agencies, freelancers, contractors, integration partners, or marketplace participants.

StartDotCom does not employ, supervise, control, guarantee, endorse, or assume responsibility for such third parties. Any agreement entered into between users and third parties is solely between those parties.

StartDotCom shall not be liable for:

• Work quality or project outcomes.
• Delays or service failures.
• Financial losses.
• Intellectual property or contract disputes arising from third-party engagements.

CHARGEBACKS AND PAYMENT DISPUTES

Users agree not to initiate unjustified chargebacks, payment reversals, or fraudulent payment disputes. Where a chargeback is initiated, StartDotCom may:

• Suspend services and restrict account access.
• Recover associated fees.
• Submit evidence to payment processors.
• Pursue recovery through legal channels.

Users remain responsible for valid subscription charges incurred before cancellation.

WEBSITE BUILDER, DOMAIN AND HOSTING TERMS

Where StartDotCom provides website generation, hosting, domain connection, SSL certificates, DNS configuration, or related services:

• Users retain ownership of their content and remain responsible for legal compliance of their websites.
• Domain registrations remain subject to registrar policies, and third-party domain providers operate independently.
• Hosting availability is provided on a commercially reasonable basis. StartDotCom does not guarantee uninterrupted hosting services.

Users remain responsible for maintaining domain registrations and renewal payments.

Failure to renew a domain may result in loss of domain ownership, and StartDotCom shall not be liable for such losses.

ECOMMERCE RESPONSIBILITY

Users operating online stores remain solely responsible for:

• Products offered, safety, descriptions, and pricing.
• Taxes, import/export requirements, and refund obligations.
• Consumer protection and regulatory compliance.

StartDotCom is not a merchant of record unless explicitly stated.

StartDotCom does not manufacture, sell, inspect, fulfil, guarantee, endorse, or verify products listed through customer stores.

ACCOUNT TRANSFER, DEATH OR INCAPACITY

User accounts are personal and non-transferable except as expressly permitted by StartDotCom.

In the event of death, incapacity, insolvency, liquidation, or dissolution of a user or business entity, StartDotCom may require legal documentation before granting access, transferring ownership, or releasing account data.

StartDotCom reserves the right to refuse account transfer requests where ownership cannot be adequately verified.

FORCE MAJEURE

StartDotCom shall not be liable for delays, interruptions, failures, or inability to perform caused by events beyond its reasonable control, including:

• Natural disasters, fire, or flood
• Pandemic or epidemic
• War, terrorism, or civil unrest
• Labour disputes or utility failures
• Internet or cloud provider outages
• Government actions / Regulatory restrictions
• Cybersecurity incidents

Performance obligations shall be suspended during such events.

DISPUTE RESOLUTION

Before commencing formal legal proceedings, both parties agree to attempt good-faith resolution through written notice and negotiation.

Where permitted by law, disputes shall be resolved individually and not as part of any collective, representative, consolidated, or class action proceeding.

Nothing in these Terms limits mandatory statutory rights available under applicable consumer protection laws.

EXPORT CONTROLS AND SANCTIONS

Users may not use the Services where prohibited by applicable export control laws, sanctions regulations, trade restrictions, or government prohibitions.

Users represent that they are not located in, controlled by, or acting on behalf of sanctioned jurisdictions or restricted parties.

StartDotCom reserves the right to restrict access where required by law.

AUDIT, FRAUD AND SECURITY INVESTIGATIONS

StartDotCom may investigate suspected fraud, abuse, security incidents, platform misuse, intellectual property violations, or payment irregularities.

Users agree to reasonably cooperate with legitimate investigations.

Failure to cooperate may result in suspension or termination.

The following provisions shall survive termination:
